Privacy policy

1. General

This Privacy and Cookie Policy describes how we at Milton BV (“SneakPeek”) handle your personal data, specifically in the context of our Website/Platform www.sneak-peek.live, the performances you book through it and our application SneakPeek.

Milton BV is not responsible for the privacy policy of the app you use to participate in the show, if it is an app other than the SneakPeek app. Milton BV is also not responsible for the privacy policy of the cultural centre, festival or other facilitator (or intermediary) of the performance.

By accepting this Privacy and Cookie Policy, you consent to the disclosure of your name, phone number and email address to Milton BV and you also consent to Milton BV processing these personal data. You are of course given the right to have this data deleted at any time. (see point 8 of this Privacy and Cookie Policy)

The modalities of your consent to this and what Milton BV does with this data are described in this Privacy and Cookie Policy.

We take the protection of your personal data seriously and comply with applicable legislation, including the General Data Protection Regulation (“AVG” or “GDPR”), and the Law of 30 July 2018 on the Protection of Individuals with regard to the Processing of Personal Data.

This Privacy and Cookie Policy applies to you because you visit the Website/Platform www.sneak-peek.live, because you are a Customer of Milton BV and/or you use the SneakPeek app. When you register for a specific performance, you will be asked to also accept a separate Privacy Policy specific to that performance.

We process your personal data in the name and on behalf of Milton BV, because of their legally defined powers and obligations, because you visit our Website/Platform, because you subscribe to a performance (hereinafter referred to as the “Services” or “the Service”), because you provide these data to us yourself and/or you use “SneakPeek”.

2. Who processes your personal data?

Milton BV, Nachtegalenlei 48, 2900 Schoten with company number 0758.609.482, represented by its director Mathijs SCHEEPERS, is responsible for processing your personal data.

3. What personal data do we process?

We collect certain personal data from our Customers. Specifically, these include the following data:

Category 1: If you register for a performance, we process your name, first name, and contact details (e-mail, phone number, address). This data is processed by us because you communicate it to us. If you subscribe to the newsletter and/or create a login, we process your email address.

Category 2: Optionally, other data may also be processed if you expressly communicate them to us, such as your interests, gender, date of birth, place of birth, professional data (profession, contractual relations, etc.), correspondence, financial data, etc. This data may be communicated to us for example if you were to contact us via email etc. Again, communicating this data to us and accepting this Privacy and Cookie Policy constitutes consent to such processing.

Category 3: We may record certain social media profile data if you contact us via social media or post something in SneakPeek’s “virtual foyer” on Facebook or another platform. Acceptance of this Privacy and Cookie policy constitutes consent to such processing.

In principle, we do not process special and/or sensitive personal data unless you explicitly communicate it to us.

Milton BV guarantees that all personal data are only viewed by Milton BV employees to the extent necessary for the performance of their duties. Moreover, these individuals are under a duty of confidentiality regarding your privacy.

4. Legal basis for processing your personal data

By communicating your personal data to us and/or accepting this Privacy and Cookie Policy when visiting the website, platform or SneakPeek app, you are granting your consent to the processing of your personal data.

In addition, by continuing to use our Services, you confirm your acceptance of this Privacy and Cookie Policy each time.

In addition, the need to provide you with any agreed Services (namely bringing you a performance via the SneakPeek app and email) also applies as an additional legal basis for processing your personal data. In other words, the performance of the contract between you and us also counts as a legal basis.

In certain cases, our legal obligation to process certain data also applies as a legal basis for processing your personal data.

5. For what purpose do we process your personal data?

We process your personal data in order to correctly provide the services you have requested, and to notify you of updates and other information related to Milton BV and our Services. Your personal data is stored in excel files with all data for data entry in the system.

We process your personal data including:

For category 1 data: to provide you with the agreed Services: following a performance, providing a login or delivering the newsletter.

For Category 1 and 3 data: to ensure, among other things, that each Customer is correctly registered.

For category 1 and 2 data: to provide you with targeted information, such as e-mails that may be of interest to you (e.g. information about new services or updates);

For category 1 to 3 data: to answer any questions from Customers.

Your personal data will be kept strictly confidential and will not be disclosed to third parties or used for direct marketing unless we have obtained your explicit prior consent (“opt-in”) as for the purposes expressly stated in this Privacy and Cookie Policy. This consent may be revoked at any time, without justification and free of charge by sending an e-mail to info@sneak-peek.live.

Partner organisations of a show and subcontractors of Milton BV (our webmaster, the partner facilitating the show and our booking office) are not considered third parties as they are indispensable for the performance of a show. Milton BV has signed a processor agreement with all these parties to ensure the security of your personal data. Therefore, in accepting this Privacy and Cookie Policy, you also consent to the sharing of necessary data, required for the execution of a performance, with partner organisations and subcontractors of Milton BV. The processing agreement that Milton BV enters into with these partner organisations and subcontractors stipulates that your personal data will be deleted immediately after a performance, and no later than 3 months afterwards.

If you have left your email address to create a login or subscribe to the newsletter, it will be kept until you indicate that you no longer wish to have a login or be kept informed via the newsletter.

Reporting of anonymised data to third parties is allowed.

We are entitled to communicate your data, in case of (suspected) serious violations of the law or of the General Terms and Conditions, to the competent judicial services or police forces (unless this would not be allowed by law). We may also do so to protect our rights or those of third parties.

6. How long do we process your personal data?

All personal data will be kept for the period necessary for us to provide the Services.

This Privacy and Cookie Policy applies as soon as you visit the Website/Platform. Likewise if you subscribe to a show, as long as the show runs and up to 3 months afterwards. After the performance, your name and e-mail address will be deleted from our files no later than 3 months after the end of the performance. If you have explicitly indicated that you wish to be kept informed of Milton BV’s activities, your email address will be kept until you unsubscribe. Therefore, if you have not explicitly indicated that you wish to be kept informed of Milton BV’s activities, your e-mail address, together with your name and phone number and your e-mail address, will be automatically deleted no later than 3 months after the end of the performance.

Location data collected as part of Geofencing is only used to notify you of nearby events, and is by no means retained.

7. Sharing personal data with third parties

Milton BV does not pass on your data to third parties, unless this is necessary for the performance of our legal obligations and powers or for the performance of the services we provide to you as described in art. 5 i.e. partners and subcontractors. If companies process your data on our behalf, we enter into a processor agreement to ensure an adequate level of security and confidentiality. Milton BV remains responsible for these processing operations. We will never sell or trade your personal data to third parties.

8. Right of access, rectification, opposition, and portability

You have the right to access your personal data free of charge at any time. This can be done by sending an email to info@sneak-peek.live or by getting in touch via the contact details on the Website/Platform or the app. You also have the right to correct or amend your personal data if it is incorrect, incomplete or irrelevant, also by sending an email to info@sneak-peek.live or by contacting us using the contact details on the Website/Platform or the app.

When requesting access or correction of data, we always ask you to attach a copy of your identity card so that we can verify your identity before communicating this information.

You have the right to oppose the processing of your personal data. This can be done by sending an e-mail to info@sneak-peek.live (also including a copy of your identity card). However, you cannot oppose the processing of your personal data if this is necessary for the performance of our contractual obligations.

Finally, you also have the right to data portability. You can exercise this by contacting us at info@sneak-peek.live .

In certain cases, Milton BV will not be obliged to comply with your request for inspection, correction, deletion or transfer. This is because of, for example, our legal obligations or reasons of public interest.

You are always responsible for the accuracy of the data you communicate to us.

10. Data breach

If you notice or suspect that a data breach has occurred, please contact us as soon as possible (by e-mail: info@sneak-peek.live or via the contact details on our websites or via the postal address mentioned in art. 2 of this Privacy and Cookie Policy), or with the Data Protection Authority (Rue du Printing Press 35, 1000 Brussels, contact@apd-gba.be, +32 (0)2 274 48 35, or via the contact details on its website www.gegevensbeschermingsautoriteit.be).

11. Safety

We take the security of your personal data seriously and have taken technical and organisational measures to protect your personal data.

However, we will not be liable for any direct or indirect damage resulting from your incorrect or unlawful use of personal data. You are solely responsible for the proper safekeeping and confidentiality of communications, contracts we send you, as well as the proper safekeeping and confidentiality of any passwords, access codes and other login details where applicable. Any careless or unlawful use of these documents or data by the Customer or by a third party (unless caused by an error on our part) is beyond our responsibility and liability. In case of loss, theft or unauthorised use of this data, you should notify us as soon as possible.
